ScaffShop purchasing and supply terms
1. Seller and scope
ScaffShop supplies professional tools, personal protective equipment (PPE), work-at-height and scaffolding equipment and accessories. We primarily work with businesses and professional customers.
Seller: MB “Arisima”, legal entity code 305968185, registered office at Perkūnkiemio g. 19, Vilnius, Lithuania. Contact address: Danės g. 15, LT-92117 Klaipėda, Lithuania. Email: info@scaffshop.lt; telephone: +370 678 34 889.
These terms apply to orders accepted by ScaffShop. Order-specific terms agreed in writing apply alongside these terms and take precedence where the parties expressly agree otherwise, but cannot remove mandatory consumer rights.
A business customer is a company or person buying for business or professional purposes. A consumer is an individual buying for personal purposes unrelated to their business or profession. Provisions for consumers apply only where the buyer meets this definition.
2. Products and placing an order
Our website and individual online catalogues present the range, product photos, descriptions, available sizes and the relationship between quantities and prices. You can enquire by email, telephone or the website contact form. Website registration is not required.
Please specify the product or code, quantity, size, colour and delivery destination. The buyer is responsible for providing accurate information. Before confirming an order, we check the selected products, availability and supply arrangements.
Sending an enquiry or viewing a catalogue does not in itself create a confirmed order. An order becomes binding when the parties agree the products, quantities, price, payment and delivery in writing and the seller confirms acceptance. Where a quotation expressly states that payment confirms acceptance, the procedure stated in that quotation applies.
3. Quantities, packaging and prices
Products may be sold individually, in packs or in boxes. Minimum quantities and pack sizes are stated for each product in the catalogue or quotation. For example, gloves may be supplied by the pack or box; the applicable quantity depends on the selected model.
Prices depend on the quantity ordered. We can provide an individual quotation for larger orders. A catalogue price does not automatically confirm stock availability or a delivery date.
Our quotation states the currency, unit price, quantity, any applicable discount, delivery charges and total amount payable. We clearly identify whether prices include or exclude VAT. Before a consumer enters into a contract, we provide the final price including applicable taxes and delivery. Additional charges are agreed before order confirmation.
A price confirmed in writing is not changed unilaterally. If we identify an error in an unconfirmed quotation, we correct it and seek fresh agreement.
4. Payment
Payment is by bank transfer against a pro forma or other invoice issued by the seller. Payment deadlines and any required advance payment are stated in the quotation or invoice. Credit terms apply only where separately agreed in writing.
Products are prepared, ordered from the manufacturer or dispatched in accordance with the agreed payment terms. If payment is late, we inform the buyer of any resulting change to dispatch timing or suspension of fulfilment. Changes to a confirmed order must be agreed in writing.
5. Delivery and collection
Delivery within Lithuania takes 1–3 working days. We also deliver to other agreed destinations. Collection can also be arranged. The exact address, method, cost and estimated timing are confirmed for each order. General delivery times on the website are indicative; timings may differ for stocked, manufactured and specially sourced products.
If we cannot meet the agreed timing, we inform the buyer and agree a solution. We do not substitute other products without the buyer’s consent. If we cannot fulfil an order and no alternative is agreed, payments for undelivered products are refunded in accordance with applicable law.
For deliveries outside the European Union, applicable charges, formalities and the parties’ responsibilities are agreed in the quotation based on the destination and agreed delivery terms.
We recommend checking the packaging and quantities on receipt. Photograph visible damage and, where possible, record it on the carrier’s documents; notify us of discrepancies promptly. Signing for delivery or failing to note packaging damage does not in itself remove the right to make a valid product-defect claim. Using a carrier does not remove the seller’s responsibilities under applicable law.
6. Product use and safety
Tools and PPE must be used for their intended purpose and in accordance with the manufacturer’s instructions, limitations and compatibility requirements. The employer or user selects suitable equipment for the workplace and ensures the necessary training and inspections. A product description does not replace the manufacturer’s instructions.
Equipment that has arrested a fall, is damaged or raises safety concerns must not remain in use until its suitability has been assessed in accordance with the manufacturer’s requirements. Service life, periodic inspections and maintenance are determined by the documentation for the particular product.
7. Quality, guarantees and claims
If a product is faulty, differs from the confirmed order or arrives in the wrong quantity, contact info@scaffshop.lt. Include the invoice or order number, the product, a description of the issue and photos where helpful. Hidden defects do not have to be identified on the delivery date.
After reviewing the case, we address repair, replacement, a price reduction or a refund in accordance with applicable law and the buyer’s rights. The guarantee does not cover normal wear and tear or defects or damage caused by misuse, failure to follow the manufacturer’s instructions, improper maintenance or storage. These circumstances are assessed on the facts of each case. This provision does not restrict the buyer’s statutory rights relating to manufacturing defects or other lack of conformity for which the seller is responsible.
Consumers benefit from a statutory conformity guarantee of at least two years from delivery, unless applicable law provides greater protection. Any additional manufacturer’s or seller’s commercial guarantee does not replace or shorten it. Business customers receive the agreed warranty terms and the seller’s statutory liability for defects.
8. Returns and exchanges of non-faulty products
Business orders. Returns or exchanges of non-faulty products must be separately agreed in writing. The consumer’s 14-day right to withdraw from a distance contract does not automatically apply to companies or people buying for their business or profession. Return arrangements and associated costs are agreed before products are sent back.
Consumer distance purchases. A consumer can withdraw from a distance contract without giving a reason within 14 calendar days of receiving the product, subject to statutory exceptions. Send a clear statement before the deadline to info@scaffshop.lt or the seller’s contact address. The sample statement below can be used, but is not compulsory.
Send the products back within 14 days of notifying us of withdrawal. We can clarify the return address and method; this does not require you to obtain additional permission to withdraw. A consumer bears the direct cost of returning a non-faulty product only where properly informed of this obligation before entering into the contract.
You may inspect the product as necessary to establish its nature, characteristics and functioning. You may be liable for diminished value caused by handling beyond this, as provided by law. Please retain accessories, labels and packaging, but merely opening the packaging does not in itself remove the right of withdrawal.
We refund payments received, including the cost of the least expensive standard delivery offered, within 14 days of receiving the withdrawal notice. Where permitted by law, we may withhold reimbursement until we receive the goods or evidence of return, whichever occurs first. Refunds use the original payment method unless expressly agreed otherwise without additional cost to the consumer.
Exceptions apply only on statutory grounds, for example to goods made to the consumer’s specifications or clearly personalised. Merely sourcing a standard product from a supplier or classifying it as PPE does not automatically create a return exception. This section on non-faulty returns does not restrict rights relating to faulty products.
9. Communications and dispute resolution
We send order confirmations and other notices to the email address provided by the buyer. Send claims to info@scaffshop.lt. We provide a reasoned response to a consumer’s written claim within 14 days of receipt, unless applicable law requires otherwise.
We first seek a direct resolution. If a consumer dispute remains unresolved, the consumer can contact Lithuania’s State Consumer Rights Protection Authority, submit a request through the Consumer Rights Information System, or apply to a court. Business disputes are addressed through negotiation and, if unresolved, by a competent court.
10. Other provisions
Personal data is handled under our privacy policy. Trademarks and website content are used subject to their owners’ rights.
Lithuanian law applies, without depriving consumers of mandatory protection under the law of their country of residence. These terms do not exclude or limit any seller liability that cannot lawfully be excluded or limited.
Updated terms apply to new orders after they take effect. Confirmed orders are not changed retrospectively without agreement, except where mandatory law requires it.
